Notice of Implementation Date for WHOIS National Laws Procedure

Today ICANN is publishing a notice of implementation of the ICANN Procedure for Handling WHOIS Conflicts with Privacy Law. The procedure will be posted for 30 days, and implemented on 17 January 2008. The draft procedure was first posted for comment on 3 December 2006. ICANN sought input on the draft procedure from the Governmental Advisory Committee (GAC).

The procedure has been revised to incorporate advice from the GAC, and is available here. New language has been inserted into Sections 1.4, 2.1, 3.1 and 5.1 of the procedure, based on input received from the GAC and from members of the ICANN Board in the Los Angeles meeting. The attached pdf shows the areas of modification in yellow. The ICANN Board discussed the draft procedure during the public meeting of the Board on 2 November 2007 in Los Angeles, and noted that “the next step now would be for the staff to update their procedure in taking into account that advice [from the GAC].”

ICANN’s Registrar Data Escrow (RDE) Program

As per ICANN’s announcement dated 9 November 2007, all ICANN-Accredited Registrars are required to deposit a backup copy of their gTLD registration data with ICANN through a Registrar Data Escrow (RDE) service provider. While ICANN has selected Iron Mountain Digital as the designated agent for the RDE program, Registrars can also use a Third Party Provider (TPP) of RDE services at their own expense.

LogicBoxes has decided to integrate with Iron Mountain Digital for the RDE program. Therefore we suggest you respond to the email received from Iron Mountain Digital, and execute the necessary agreements.

Application Round Opens for Paris Meeting Fellowships

Program makes sure global voices are heard at ICANN’s International Public Meetings

MARINA DEL REY, Calif. : The Internet Corporation for Assigned Names and Numbers is putting out the call for fellowship program applications for its 32nd International Public Meeting to be held in Paris from 22-27 June 2008.

“The fellowship program plays a key role in making sure that global voices are heard at the ICANN meeting and in our various public forums,” said Theresa Swinehart, ICANN’s Vice President, Global and Strategic Partnerships.

Implementation of Registrar Data Escrow Program

ICANN has concluded negotiations and entered into an agreement with Iron Mountain Intellectual Property Management, Inc. to provide escrow services under ICANN’s Registrar Data Escrow (RDE) program. ICANN selected Iron Mountain through a competitive Request for Proposals process concluded earlier this year.

Under the data escrow provision of the Registrar Accreditation Agreement (RAA), all ICANN-accredited registrars must regularly deposit a backup copy of their gTLD registration data with ICANN through ICANN’s arrangement with Iron Mountain or they may elect to use a Third Party Provider of RDE services that has been approved by ICANN. The data held in escrow may be released to ICANN upon termination of a registrar’s accreditation agreement or expiration of the accreditation agreement without renewal to facilitate transfer of registrations from the failed registrar to another registrar. ICANN plans to have all accredited registrars enrolled in the RDE program within the next six months.

“The vast majority of ICANN-accredited registrars offer high levels of service and integrity,” said Dr. Paul Twomey, ICANN’s President and CEO. “But as we have seen, there is the risk that a poorly performing registrar can hurt registrants significantly. ICANN’s Registrar Data Escrow program provides an important additional layer of protection for registrants.”

ICANN and Iron Mountain will begin enrolling registrars in the RDE program immediately. Registrars who elect to use Iron Mountain’s escrow service will be required to enter into a standardized agreement with ICANN and Iron Mountain [PDF, 49K]. Escrow agents who wish to apply for approval as a Third Party Provider (TPP) should review ICANN’s TPP Approval Criteria [PDF, 21K] and TPP Approval Process Diagram [PDF, 121K], and submit a completed TPP Application [PDF, 21K, MS Word, 61K] to ICANN. All registrars and escrow agents must comply with ICANN’s RDE Specifications [PDF, 33K].

.ASIA Registry Announces “Pioneer Domains Program”

The .ASIA registry has launched the “Pioneer Domains Program” which is designed to award .ASIA domain names to applicants based upon relevant content and business plans. Applicants for the Pioneer Domains Program will also be required to submit a deposit in most cases, which will be refunded if the registry does not award them the domain name in question.

This Program consists of three categories:

  • Community Pioneer: which is open to individuals, businesses and other organizations that wish to apply for generic words;

  • Global Brand Pioneers: for “well-established brand owners to develop active and relevant Web sites and services; and

  • Partner Pioneers: which is designed for accredited registrars, technology and service providers to promote the .ASIA extension.

While the Sunrise period is designed to provide comprehensive protective measures for trademark owners, the registry says the Global Brand Pioneers category “offers proactive brand holders who are committed to the Asia community the .ASIA domains that best match their mark and businesses.”

For the Community Pioneer Program, Applicants are expected to fill in the application form and also include a brief proposal outlining:

  • Business and Marketing Plan: describing the concept and proposed scheme for the .Asia domain, along with activities and ideas for promoting the domain;

  • Operations and Financial Support: resources and support available for viability of the initiative and to execute on the proposed plans; and,

  • Community and Social Considerations: commercial and social benefits to the community

In order to qualify for the Global Brand category, the registry says a brand must have or demonstrate:

  • Trademark registrations in multiple countries and/or regions, with at least one in Asia;

  • Significant investment into the development and promotion of the corresponding brand online and offline; and,

  • Substantial sales threshold in connection with goods and services associated with the mark.

Although marketing commitment deposit is not applicable for partner Pioneer Program, commitments and pledges for the provision of complimentary, considerably discounted or exceptionally favorable terms of services or products to DotAsia will be required.
